An investigation by the BBC, published this week, has identified the astonishing numbers of people who last year had to wait more than 24 hours to be admitted to hospital in the north-west region.

For a range of reasons, including increasing demand and reduced bed availability due to pressures on social care, more than 50,000 patients across the north west region experienced what is being termed ‘corridor care’, waiting until a bed is available for them to be formally admitted to hospital.

As well as concerns about the pressures which this puts on hospital staff and the lack of dignity for the patients themselves, this scenario also raises the possibility that the quality of care will be compromised.

Delays in treatment, pressures on nursing time and availability, and inappropriate provision can all increase the likelihood that an error in patient care will occur.

Where this distressing situation arises, and the patient suffers as a result, it may be appropriate to make a claim for compensation which would address the impact of the failings on the patient, their long-term well-being and financial losses.

A patient is legally entitled to claim compensation if negligent medical care, for whatever reason, causes them to suffer a worse outcome than should have been the case with an acceptable level of care.

Where appropriate, and where an act of negligence is found to have taken place, a successful claim will take account of the patient’s pain, suffering and financial losses insofar as they have been caused by the negligence.
