When Can I Make a Claim for Compartment Syndrome?

When Can I Make a Claim for Compartment Syndrome?

If you or a loved one are struggling with the effects of compartment syndrome due to medical negligence, it may be appropriate to make a claim for compensation.

Timing in medical negligence compensation claims

An important point to remember is that compensation claims for medical negligence have to be commenced within three years of the date of the negligent incident. For example, if a patient suffered a negligent perforated bowl in April 2019, the limitation date for their compensation claim would be April 2022.

Although there are occasions when this limitation date can be extended, it is advisable to initiate a claim promptly, when recall of events is clearer. And, of course, the sooner a claim is started, the sooner it will be completed.

When to make a claim for compensation?

It might be appropriate to make a claim for compartment syndrome, if it is clear that the patient's condition has been caused by negligence on the part of the medical professionals.

Compartment syndrome can develop in the limbs when pressure builds up within a muscle compartment, threatening the blood vessels and nerves and causing loss of function. This scenario may require an immediate medical response to reduce the pressure and enable continued function. A failure to prevent or diagnose compartment syndrome may be regarded as negligent and may leave the patient permanently disabled. This can occasionally happen if, for example, a patient undergoing extended surgery is left with their legs raised for the duration of surgery. Guidelines indicate that the position should be relaxed at some point in order to allow pressure in the limbs to reduce.

If the impact of the negligent compartment syndrome causes the patient to suffer on-going effects and financial losses, a claim for compensation may be a helpful way forward. If an individual has been left unable to work or only able to manage part-time work due to their condition, a successful compensation claim should be able to address those financial losses.
