When Can I Make a Claim for Negligent Medical Care?

A patient may make a claim for compensation for medical negligence where both the following circumstances apply:
- Where an act of negligence or breach of duty has occurred during the course of their medical care. This can vary considerably from a life-changing incorrect prescription of medication, to a misdiagnosis of a significant illness or condition, to negligent surgery causing a dramatic impact, and
- Where a negligent act by a medical professional has caused a patient to suffer a worse outcome than would have been the case with an acceptable level of care.
Timing in medical negligence compensation claims
It is important to remember that compensation claims for negligent medical care are restricted legally by specific timeframes. If you believe that you or a loved one have been the victim of negligent care, your claim needs to be initiated within three years of the date of the alleged negligence. This does not mean that you have three years within which to obtain the services of a solicitor. This is the date by which your claim needs to be issued with the court and a specialist medical negligence solicitor will need plenty of time before that in order to investigate the validity and value of your claim.
If you think you may have a claim, you should contact a specialist solicitor as soon as possible after the negligent event(s). This will give them time to obtain your medical records and instruct the best medical experts to assess the quality of your care and the impact of the negligence if any has occurred.
However, it is occasionally possible for this time limit to be extended so, even if you believe you may be out of time to make a claim, it is best to talk to an expert lawyer in case an extension may be possible in your situation.
