Negligent Surgical Procedure and When to Claim Compensation

A negligent surgical procedure can be a minor issue. It can also be a catastrophic disaster, permanently altering the life of the patient. If you or a loved one have suffered due to negligent surgical care, it may be possible to make a claim for compensation.

The right to compensation

If negligent medical care causes a patient to suffer a worse outcome than would have been the case with an appropriate level of care, the patient is legally entitled to make a claim for the consequences.

In addition to compensation for the damage caused, the patient can claim compensation for the financial impact, both past and future, which the negligent care has caused. This can include the costs of care, the costs of alterations to the home where necessary and the loss of income or pension if appropriate.

Negligent surgical care

The wide variety of surgical procedures which take place across the UK on a daily basis put patients at risk of an equally wide variety of consequences.

Negligent or substandard care could cause nerve dysfunction, bowel dysfunction, sepsis, visual problems or brain injury, to name just a few, as well as scarring, psychological and cognitive problems and even loss of life.

Negligent surgical care may occur during various procedures such as orthopaedic surgery, exploratory ERCP procedures, spinal surgery and hysterectomy to name just a few.

When to make a claim

Bear in mind that compensation claims for medical negligence are associated with a time limitation. Claims must be initiated with the court within three years of the date of the alleged negligence. Although, the care can occasionally be an extension to this deadline, it is best to be cautious and speak to a specialist solicitor well in advance of this date. Your solicitor will need to investigate your claim and this can take a considerable amount of time.

If expert investigation finds that you or a loved one do, indeed, appear to have been the victim of negligent surgical care, and that it has had a significant impact on your quality of life, it may be appropriate to make a claim.
