Misdiagnosis Claims and Medical Negligence

Misdiagnosis Claims and Medical NegligenceMaking a claim for compensation following medical negligence may help you to come to terms with the consequences of that failing.

The right to compensation for negligent care

If you are severely affected by negligent medical care, you are legally entitled to make a claim for compensation. A successful compensation claim will address not only your unnecessary pain and suffering but will also take into account the financial impact which the negligence has had on your well-being and quality of life.

For example, if negligent care has meant that you are no longer able to work or are restricted in the nature or duration of employment which you can undertake, a successful claim would include both the past and future loss of income in so far as it has been caused by your negligent medical care.

Likewise, if the results of negligence have left you dependant on personal care or requiring specialised equipment or household adaptations in order to live safely and effectively, the associated costs could be included in a claim.

The consequences of a medical misdiagnosis

For some patients, a misdiagnosis of their symptoms may cause no significant long-term impact. Their condition may not deteriorate and a delay in the commencement of treatment may make little difference to their long-term outcome.

For others, however, a misdiagnosis can prove catastrophic.

  • A misdiagnosis of a serious condition may mean the vital tests and investigations are not carried out in a timely manner and the severity of the patient's condition worsens in the intervening period
  • A misdiagnosis may mean that the patient is started on a course of treatment, whether medication or surgery, which proves to be unnecessary and disabling
  • A misdiagnosis may mean that the patient is not given red flag warnings and no safety-netting measures are put in place, allowing time to pass and the patient's condition to worsen
  • A misdiagnosis may mean that the patient does not receive the treatment they need
