How Can I Get Compensation for Negligent Medical Care?

How Can I Get Compensation for Negligent Medical Care?If you suspect that either you or a loved one have been the victim of negligent medical care which has left you suffering debilitating symptoms, your first step is to speak to a solicitor who specialises in this complex area of the law.

Initiating a claim for compensation

Compensation claims for medical negligence require considerable expertise. Before a claim can be issued with a court, it is necessary for a thorough investigation to be carried out into the patient's medical care. A specialist solicitor will be able to obtain all the necessary medical records and instruct the best medical experts to analyse the quality of care. If it appears that there has, indeed, been a breach of duty or act of negligence, they will then assess whether or not that act of negligence has caused the patient to suffer a worse outcome than would have been the case with an acceptable and appropriate level of care. If so, it may be possible to claim compensation.

If, as a result of this investigation, it is found both that there was a breach of duty and it did cause an adverse outcome for the patient, your solicitor will need to issue your claim with a court before the three year deadline is up. This deadline refers to three years after the date of the alleged negligence and it is important to bear this in mind. It might be possible to extend this deadline but it is a good reason to contact a specialist solicitor at the earliest possible moment.

Compensation claims

As well as considering the patient's pain and suffering, a successful compensation claim addresses the financial losses, both past and future, which have been suffered by the patient insofar as they have been caused by the negligence.

For example, if a patient finds that they have to change the nature of their employment or even that they are no longer able to work at all, their loss of income would be included in a claim.

If their symptoms are causing them additional costs, such as care costs or amendments to their home, these costs could also be included in a claim.
