Compensation for Cholecystectomy Damage

Compensation for Cholecystectomy Damage

Damage to the bile duct or surrounding organs and abdominal structures during gallbladder surgery can have life-threatening consequences and may justify a claim for compensation.

The abdominal anatomy around the gallbladder and bile duct is both complex and varying. Any damage which occurs during the course of a cholecystectomy to remove the gallbladder requires immediate attention. If negligent damage occurs or is missed by medical professionals, the patient may suffer severe consequences.

Cholecystectomy operations are frequently carried out through keyhole surgery (laparoscopy) which can present difficulties where the surgeon's field of vision is concerned. Although generally highly successful procedures, problems do occasionally occur.

Problems associated with gallbladder surgery

  • The bile duct which transfers bile from the liver to the small intestine may be accidentally damaged either though being cut by surgical instruments or by being compressed. This may present a number of difficulties. Bile may leak from the bile duct into the abdomen, causing the patient to become seriously ill. Alternatively, if the bile duct is damaged or obstructed, it may impair the movement of bile out of the liver, causing the patient to develop jaundice.
  • If a nearby abdominal organ such as the small intestine is damaged during a cholecystectomy, causing a bowel rupture, the patient may develop peritonitis as bacterial matter leaks into the abdomen and infects the peritoneum or lining of the bowel. This can be life-threatening.

Medical negligence

Medical professionals may be regarded as having provided substandard care if they cause damage due to negligence. If their preparation, procedures or decision-making during surgery have caused the patient to suffer damage and long-term problems, it may be appropriate to make a claim for compensation.

If any physical damage negligently caused during a cholecystectomy is not promptly diagnosed and treated, it may be considered that the patient has received a substandard level of care.
