In the vast majority of cases, joint surgery, such as the replacement of a hip or a knee, is very successful and the patient goes on to a good recovery and re-discovered mobility. Occasionally, however, negligent complications may justify the patient in making a claim for compensation.

Negligence related to knee and hip operations can cause significant problems, possibly presenting the patient with greater difficulties than they were previously experiencing.

Post-operative infection

An infection in the site of a knee or hip replacement can be far more serious than it sounds.

As well as possibly causing the patient to suffer devastating complications of the infection, such as life-threatening sepsis, it may require the new joint to be removed in order to resolve the infection problem.

This will require the patient to undergo further risky surgical procedures before their problems are resolved, should that ever prove to be the case.

If the infection and its consequences are found to be due to medical failings, it may be appropriate to make a claim for compensation.

A failure to identify or diagnose symptoms of infection or a failure to protect the patient against infection may be regarded as negligent.

Nerve injury

A fairly rare complication, it is nonetheless potentially devastating when a nerve does occur. Depending on the nature of the nerve it is likely to impact on some aspect of the patient's capacity to experience sensation and initiate movement of the muscles.

A femoral nerve injury, for example, during hip surgery can cause long-term loss of mobility and an array of associated life-style and employment problems.

Where such an injury is the product of medical negligence, it may be appropriate to pursue a claim for compensation.

Failed or negligent surgery

Occasionally, too, the quality of the joint replacement is substandard. It may cause the patient on-going pain. It may need to be amended, requiring further surgery.

If this is the product of poor-quality medical care, a successful compensation claim may enable the patient to recover their financial losses caused by the impact of the negligence.
