When Can I Make a Compensation Claim for Fournier's Gangrene?

There are two issues within this question. One relates to the legal time limits for making a claim. The other relates to the circumstances when a claim might be appropriate.

Timing in medical negligence claims

If a person believes that they may have been the victim of medical negligence, they need to issue their claim within three years of the date of the alleged negligence.   • A failure to recognise or suspect the possible symptoms of fournier's gangrene, resulting in delayed treatment, may change a person's life and justify a claim for compensation
  • A failure to carry out an examination, resulting in a delayed diagnosis may be regarded as negligent
  • A delay in making a referral for investigation may be regarded as negligent
  • A failure to treat a medical condition such as an abscess, allowing fournier's gangrene to develop and leading to a poor outcome may be regarded as negligent
  • A delay in initiating debridement treatment, allowing the infection to spread and causing a poor outcome may be regarded as negligent
