Negligent Necrotising Fasciitis Disability and Claiming Compensation

Negligent medical care of necrotising fasciitis can leave a patient with permanent disability. If this is the case for you or a loved one, contact Glynns Solicitors to discuss the possibility of making a claim for compensation.

The legal right to compensation

If a patient experiences substandard medical care which leaves them in a worse long-term position than had they received an acceptable level of care, they are entitled by law to make a claim for compensation. Such a claim addresses not only the pain and suffering and loss of amenity experienced by the patient but also takes account of any financial losses caused by the effects of the negligence.

For example, if the patient suffers significant disability, such that they can no longer work, due to delayed diagnosis and treatment of necrotising fasciitis, their compensation claim would include a claim for the loss of past and future earnings where this has been caused by the impact of the negligent medical care.

Necrotising fasciitis disability

The impact of necrotising fasciitis, a soft-tissue infection, can result in devastating and debilitating disability. Often commencing in the limbs, a patient may suffer the loss, total or partial, of a limb due to the need to halt the spread of the infection.

If this appalling infection affects the abdomen, as is also often the case, it can lead to loss of bowel function and the need for a stoma.

The surgical debridement of tissue needed to treat this infection can, in itself, cause significant and distressing deformity as well as necessitating further restorative surgery.

Not only may a patient find that there are restricted in what they are able to do, they may also find that they require personal support to carry out daily hygiene and household tasks.

Diagnosis and treatment as a matter of emergency

If a patient exhibits the possible symptoms of necrotising fasciitis, whether in primary care or in hospital, it is essential that their symptoms are investigated and, where necessary, treated as a matter of emergency. Any delay can allow this virulent infection to spread, threatening the life of the patient.

If medical professionals fail to recognise or suspect the symptoms of necrotising fasciitis, thereby allowing the patient to suffer a worse outcome than necessary, they may be regarded as having provided substandard care and it may be possible to make a claim for the adverse long-term outcome and effects.
