Claiming Compensation for Necrotising Fasciitis Negligence

The long-term devastation which can be caused by a necrotising fasciitis infection can be difficult to overstate. If the outcome from this appalling illness has been made worse by negligent medical care, it may be appropriate to make a claim for compensation.

The right to claim compensation

If a patient suffers a worse outcome following substandard medical care than would have been the case with an acceptable level of care, they are legally entitled to make a claim for the impact of that negligence.

For example, if a patient is no longer able to work because of the impact of medical negligence, or is dependent on personal care, a successful compensation claim would take those financial losses or costs into account.

The impact of necrotising fasciitis

Suffering a necrotising fasciitis infection can cause devastating physical and psychological effects. It can even cause the death of the patient as the virulence of the infection is associated with a high mortality rate.

This appalling infection causes the body's tissue to die. Spreading rapidly, it can soon threaten the life of the patient. The only way to halt the spread of the infection and minimise the damage caused, is for all infected tissue to be surgically removed. This in itself can cause both physical and emotional trauma, frequently requiring numerous surgical procedures before all infection has gone. Occasionally, it may even necessitate the removal of one or more limbs or fingers or a hand or foot. If the patient survives, they will then need to undergo further surgery to try to restore the lost tissue and amend any deformity caused by the infection.

Many patients are left with permanent disability and distress.

Diagnosis and surgery

Not surprisingly, necrotising fasciitis is a medical emergency and any delay can prove life-changing or, at worst, fatal.

Although rare, it is essential that medical professionals faced with the possible signs and symptoms of this horrific illness either suspect the nature of the infection or demonstrate a willingness to refer a patient urgently for further investigation.

A misdiagnosis or delay in referral may prove life-threatening.

The commencement of surgery for necrotising fasciitis is also a matter of emergency and any delay may be regarded as negligent and justify a claim for compensation.
