Symptoms of Cauda Equina Syndrome and Compensation for Medical Negligence

Symptoms of Cauda Equina Syndrome and Compensation for Medical Negligence A patient visiting their GP or Accident and Emergency service with the possible symptoms of cauda equina nerves may need to undergo emergency surgery to decompress compression of the nerves in the lumbar region of the spine.

A failure by medical professionals to recognise the symptoms or to make an appropriate referral may lead to life-changing consequences for the patient.

Symptoms of cauda equina compression

If a patient is developing compression of the cauda equina nerves, the function in their lower body is likely to be affected and they may exhibit some of the following symptoms:

  • Lower back pain
  • Radiating pain in both legs
  • Altered motor function in the legs such as foot drop
  • Altered sensation in the saddle area such as loss of sensation
  • Altered urinary function such as having to strain
  • Altered awareness of needing to defecate

The possibility that the patient is suffering from compression of the nerves may need to be ruled out with an MRI scan. If this shows that they are, in fact, suffering from compression, they may require emergency surgery.

A failure by medical professionals to identify, diagnose or respond appropriately to a patient with the possible symptoms of cauda equina nerve compression may be regarded as negligent and may justify a claim for compensation.

A failure to provide red flag advice to a patient who may be at risk of developing these symptoms may also be regarded as negligent as it may cause the patient not to attend hospital should their symptoms worsen and thereby lead to a delay in surgery.

Claiming compensation

If the patient suffers a worse long-term outcome due to a delay in diagnosing their cauda equina compression, it may be appropriate to make a claim for compensation.

A delay in carrying out surgery to decompress the nerve can leave the patient with permanent loss of mobility and double incontinence.

A successful compensation claim would address the financial consequences of these problems such as a loss of income if the patient is now restricted in their capacity to work, and any costs of care, treatment or equipment.
