Spinal Nerve Problems and When to Claim Compensation

Spinal Nerve Problems and When to Claim CompensationPain in the lower back is not necessarily a symptom of nerve compression nor or cauda equina syndrome. However, when combined with other symptoms, a failure by medical professionals to consider this possibility may be regarded as negligent and may, if the patient suffers a poor outcome, justify a claim for compensation.

Cauda equina syndrome

Cauda equina syndrome is caused by the compression of the cauda equina nerves in the lumbar region of the back. As the nerves become squashed, they begin to lose their ability to function as communicators of sensation and movement between the lower body and the brain. As the compression increases, so too does the lower body function loss. Without prompt diagnosis and surgery to decompress the nerve, the patient may suffer permanent and disabling symptoms including the following:

  • Loss of the ability to control the passing of wind
  • Loss of the ability to control the passing of faeces
  • Loss of sexual function
  • Loss of mobility

This devastating combination of symptoms can turn an individual's life upside-down, depriving them of their independence and their ability to work as well as restricting their access to many social activities and limiting their ability to carry out many ordinary daily tasks.

When negligence plays a role

Early diagnosis is essential. Consequently, if medical professionals are presented with an opportunity to diagnose this appalling condition at a stage when the patient still retains much of their function, but fail to do so, they may be regarded as having been negligent.

Examples of negligence in relation to the diagnosis and treatment of cauda equina compression could include the following:

  • A failure to recognise the possible early symptoms of cauda equina compression, leading to a delay in making a referral for an MRI scan
  • A failure to examine a patient for possible additional indicators of spinal compression
  • A failure to make an appropriate and timely referral
  • A delay in initiating surgery
  • A failure to provide a patient with red flag warnings, thus delaying their presentation at hospital when these symptoms develop
