Medical Referral Errors in Cauda Equina Syndrome Care

Medical Referral Errors in Cauda Equina Syndrome CareThe timing of a referral in the diagnosis of cauda equina compression is crucial. An MRI scan to assess the condition of the cauda equina nerves may be a matter of emergency. And if medical professionals, whether in the GP surgery or in hospital, delay making a referral, they may be regarded as having been negligent in their care of the patient.

Referring the patient for further tests

If a medical professional suspects that their patient may have the symptoms of cauda equina compression, they may need a referral for an immediate MRI scan.

Symptoms which might suggest that the patient is developing compression of the cauda equina nerves could include lower back pain alongside altered sensation and pain in the legs as well as altered urinary function and altered sensation in the saddle area between the legs.

Failures in regard to MRI referrals could include the following:

  • A failure to make a referral for an MRI when it would normally have been regarded as necessary
  • A delayed referral for an MRI scan which allows time for the patient's condition to deteriorate
  • A failure by a hospital or medical facility to transfer a patient to suitable facilities if such are not available locally

If the medical professional considers that an MRI scan is not necessary at this stage, it may still be necessary for them to advise the patient as to the red flag symptoms which should prompt an immediate hospital attendance.

A failure to provide such advice may also be regarded as negligent and may justify a claim for compensation.

Making a claim for compensation

A successful compensation claim would address the difficulties which the patient is experiencing insofar as they have been caused by the negligent care.

This can often include financial losses such as a loss of income where the patient's capacity to work has been compromised. It can also include the costs of care or equipment or household alterations where this is necessary.
