Discharged with Cauda Equina Syndrome: Claiming Compensation

Many of our clients come to us after they have been discharged from Accident and Emergency although their symptoms indicated that, in fact, they were developing the shocking condition that is cauda equina syndrome.

Timing in cauda equina syndrome diagnosis

An early diagnosis is crucial in a patient who is developing cauda equina syndrome. This progressive condition commences with compression of the cauda equina nerves at the base of the spine and can develop into significant loss of function in the lower body.

A failure by medical professionals to recognise that their patient may be displaying signs and symptoms of nerve compression can allow time for the degree of compression and loss of function to progress.

An early diagnosis can lead to early surgery and recovery of function. For this to happen, however, requires medical professionals to recognise the possible early symptoms, to carry out a thorough assessment for red flag symptoms and be prepared to make a referral for an emergency MRI scan where their tests have suggested that this is necessary.

A delay in diagnosis can lead to a lifetime of double incontinence, sexual dysfunction and loss of lower limb mobility.

Life with complete cauda equina syndrome can be grim, indeed, as loss of independence and an inability to work can form part of the patient's future.

Timing in cauda equina syndrome surgery

If a patient who is developing cauda equina syndrome still retains some bladder control, it is widely considered as essential that they undergo decompression surgery as a matter of emergency within hours.

Patients whose surgery is delayed are thought to be less successful in recovering the lower body function which they have already lost. In fact, if their condition has continue to deteriorate in the time between diagnosis and surgery, their long-term outcome may be even worse.

Medical negligence

Consequently, for a patient to be discharged from Accident and Emergency with a false reassurance that their symptoms do not warrant an MRI scan, may be regarded as negligent.

Furthermore, if they do not receive warning as to the red flag symptoms which should prompt them to return to hospital immediately, they may also be considered to have received substandard care.
