Decompression Delayed for Cauda Equina Syndrome: Can I Claim?

If you or a loved one are struggling with the consequences of a delay in surgery for cauda equina compression, you may be able to claim compensation.

The right to compensation

If a patient suffers a poor outcome due to negligent medical care, the law allows them to make a claim for compensation for the effects of that negligence.

What this means in the case of decompression surgery is that, if it is considered that a delay in initiating surgery caused the patient to suffer a worse outcome than would have been the case with earlier surgery, had that been possible, the patient would be entitled to make a claim for compensation.

If the delay in surgery has left the patient with debilitating levels of disability which may cause them to experience an income loss or necessitate care costs, for example, those financial losses would be included in a successful compensation claim.

Delayed decompression: why does it matter?

A delay in diagnosing and treating cauda equina syndrome can sometimes mean that the patient's condition deteriorates in the meantime, leaving them with a worse outcome than they would have experienced with more timely diagnosis and surgery. In the case of this appalling condition, this can mean double incontinence and loss of mobility.

This is not always the case. A patient's nerve compression and lower body symptoms may not alter during the process of diagnosis and surgery. However, if medical professionals had the opportunity to diagnose and treat this appalling condition but failed to do so or were slow in their response and the patient suffers a worse outcome as a result, the relevant professionals may be regarded as having been negligent and it may be appropriate to make a claim.
