Complete Cauda Equina Syndrome Negligence and Compensation

Complete Cauda Equina Syndrome Negligence and CompensationIf you or a loved one are suffering the appalling impact of complete cauda equina syndrome due to delays in medical care, it may be appropriate to make a claim for compensation. Contact Glynns Solicitors, specialists in medical negligence law.

Complete cauda equina syndrome

A patient with complete cauda equina syndrome is suffering from severe cauda equina nerve compression causing an array of debilitating symptoms including incontinence of both bladder and bowel as well as sexual dysfunction and loss of mobility or paralysis.

This appalling condition generally develops over time as the compression of the nerves increases, meaning that, if it is diagnosed and treated at an early stage, there is a possibility that the patient may only suffer limited function loss.

At the point where the condition is still incomplete it is regarded as a medical emergency with surgery needed within the earliest possible timeframe to avoid further deterioration.

Negligent medical care

It is, therefore, essential that, where possible, medical professionals provide timely and competent care in order to achieve the earliest possible diagnosis and a prompt surgical response.

A medical response which may be regarded as negligent could include the following:

  • A failure by a medical professional to recognise that the patient's symptoms, such as lower back and leg pain, altered saddle sensation or altered urinary experience may be indicative of cauda equina compression
  • A failure to carry out a thorough assessment or tests to check for additional indicators or signs of cauda equina compression
  • A failure to make a timely referral which, in some circumstances may mean an immediate referral for an MRI scan
  • A failure to provide a patient with red flags warnings of the symptoms which should prompt them to attend Accident and Emergency immediately
  • A delay in initiating surgery, thereby allowing the patient's condition to worsen

When to claim compensation

If you or a loved one have experienced negligent medical care in relation to cauda equina syndrome which has caused you to suffer a worse outcome than should have been the case with competent care, you should be legally entitled to compensation for the consequences of that negligence. This would include financial losses where these are relevant.

It is also important to bear in mind that compensation claims need to be issued within three years from the date of the alleged negligence and a thorough investigation into your medical care is required before that deadline.
