Compensation for Herniated Disc Negligence in Cauda Equina Syndrome

A delayed investigation of the symptoms of cauda equina syndrome may leave the patient with permanent disability and may justify a claim for compensation.

Diagnosing a herniated disc

A herniated or ruptured disc in the spine can put pressure on the nerves within the spinal cord, potentially causing a range of sensation and function difficulties. If this happens to the cauda equina nerves at the base of the spine, it can cause catastrophic lower body disability. Without prompt diagnosis and surgery, the patient may face a lifetime of double incontinence, sexual dysfunction and lower limb paralysis.

If a patient is exhibiting possible symptoms of cauda equina syndrome, it is essential that the underlying cause is identified. If the cauda equina nerves are suffering compression, the patient will need emergency surgery to decompress the nerves.

For this diagnosis to be achieved, it is necessary for the patient to undergo an MRI scan. A timely referral for an MRI scan is fundamental to a good outcome from this terrible condition.

Symptoms of possible cauda equina compression

Symptoms which might indicate that the patient is suffering from compressed cauda equina nerves and is in need of an MRI scan would include the following:

  • Pain in the lower back
  • Pain and altered sensation in both legs
  • Altered sensation in the saddle area between the legs and around the buttocks
  • Altered urinary experience such as having to strain to empty the bladder
  • Altered awareness of needing to urinate

Negligence in relation to diagnosis of a herniated disc

A delay in the diagnosis of cauda equina nerve compression due to a herniated disc may occur for a number of reasons:

  • A failure to make a referral for an MRI scan
  • A delay in arranging an MRI scan, or a failure to transfer a patient in a timely manner to facilities where an MRI scan can be carried out
  • A delay in reporting the results of an MRI scan
  • A misinterpretation of the results of an MRI scan
