New Mother Incontinence and When to Claim Compensation
Speak to a specialist solicitor if you think that you may have been the victim of negligent maternity care.
New mother incontinence
If you are experiencing significant anal leakage of wind and faeces following the vaginal birth of your baby, this may not be normal. You may even be suffering leakage from the vagina.
These distressing symptoms might suggest that you suffered a 3rd or 4th degree tear during the birth of your baby which has not received the medical attention it needs.
First-time mothers are at a greater risk of suffering a severe birth tear than women who have given birth before and the medical care you received following the birth of your baby should have ensured that any injury to your anal muscles was identified.
Negligent maternity care
Negligence during this important period of time can leave a woman with a serious injury which has not been repaired and the likelihood of a successful repair after time has elapsed may be reduced.
Negligent care could include the following:
- A failure to carry out a digital rectal examination following the birth of your baby to check for any anal damage
- A failure to identify that any damage has occurred
- A misdiagnosis of damage, for example diagnosing a 3c tear as a 3a tear
- A failure to carry out an effective and comprehensive repair
Bowel symptoms of wind and faecal incontinence can be extremely distressing as well as causing significant practical problems. In some circumstances, it can mean that the mother is either unable to return to work or that she is no longer able to do the type of work she had previously done. As well as the emotional impact of such an outcome, it can also mean that the woman experiences a significant reduction in income.
When to make a claim
If negligent maternity care has caused a woman to return home with an unrepaired 3rd or 4th degree tear and disabling bowel problems, adversely affecting her quality of life, she should be entitled to claim compensation for the consequences.
Contact a specialist solicitor as soon as possible. Although women often find these conversations difficult, rest assured that an experienced medical negligence specialist will be very aware of the problems which you may be suffering and will understand the difficulties you face.
A successful claim will take account of those difficulties and the financial impact on your life.
