Can I Claim for a Poor Third Degree Tear Repair?

Can I Claim for a Poor Third Degree Tear Repair?

If an inadequate or incompetent repair of a severe perineal tear has left you with debilitating, long-term symptoms, you may be entitled to make a claim for compensation.

Severe tear symptoms

If a woman suffers a severe third of fourth degree tear at the birth of her child, she requires an immediate and skilled repair of her anal sphincter damage in an operating theatre.

Without such care, she may be left with the following symptoms:

  • Extreme urgency when needing the toilet
  • Inability to prevent he passing of faeces (incontinence)
  • Inability to prevent the passing of wind
  • Perineal infections
  • Discomfort during sex

The more time passes before diagnosis is made and a repair carried out, the more likely it is that the woman will continue to suffer these appalling symptoms.

Understandably, these symptoms can frequently make life extremely difficult. Employment in many types of work can become almost impossible and many women find that their capacity to earn an income is severely diminished. In such circumstances, a compensation claim may be even more important.

Making a claim

It might be appropriate to make a claim for a severe perineal tear if your injury was not properly repaired (in many cases, no repair has been carried out at all) and you have been left with on-going symptoms.

This is most likely to be because your injury was not accurately diagnosed at the time of the birth. You may not have received a thorough examination and, therefore, it may not have been apparent that you had suffered an anal sphincter injury. Consequently, your repair is likely to be inadequate in that only part of the injury will have been repaired.

Alternatively, you may have received a diagnosis but an incompetent repair was carried out which has meant that your symptoms continue to deteriorate.
