Can I Claim for a Poor Third Degree Tear Repair?

If a woman suffers a severe third of fourth degree tear at the birth of her child, she requires an immediate and skilled repair of her anal sphincter damage in an operating theatre.

  • Inability to prevent he passing of faeces (incontinence)
  • Inability to prevent the passing of wind
  • Perineal infections

Making a claim

You may not have received a thorough examination and, therefore, it may not have been apparent that you had suffered an anal sphincter injury. Consequently, your repair is likely to be inadequate in that only part of the injury will have been repaired.

Alternatively, you may have received a diagnosis but an incompetent repair was carried out which has meant that your symptoms continue to deteriorate.
