Can I Claim Compensation for an Anal Sphincter Birth Tear?

Symptoms of an anal sphincter birth tear may indicate that you have suffered medical negligence. They may also justify a claim for compensation.

Medical negligence and birth tears

If you suffered a tear to your anal sphincter during vaginal childbirth, you should have received a prompt and effective repair in an operating theatre. It is to be hoped that you are no longer suffering from bowel symptoms.

Severe birth tears do sometimes occur during childbirth. In fact, around 5% of women giving birth through the vagina experience this injury, with first-time mothers being more susceptible. It is not necessarily a sign of negligence and does not necessarily justify a claim for compensation.

However, if your tear was not diagnosed or repaired and you are continuing to suffer debilitating symptoms, it may be appropriate to make a compensation claim.

The impact of an unrepaired birth tear

The long-term symptoms of a severe birth tear, such as a third or further degree tear, can be life-changing. Losing the ability to control the passing of wind and faeces can affect a woman's confidence, her willingness to leave the home and socialise, her personal relationships and her ability to work.

Diagnosing a severe birth tear

It is, therefore, essential that medical professionals check very carefully for any signs of perineal and anal damage after a vaginal birth.

It is vital not only that a birth tear is identified but that it is accurately and precisely diagnosed. The extent and severity of a perineal tear can vary considerably. There is a big difference between a woman who has suffered a 1st degree tear and one who has suffered a fourth degree tear, damaging her perineum and both her external and internal anal muscles.

If a thorough examination does not take place, however, it is probable that any damage will not be accurately identified. In these circumstances, the woman may not receive a full and effective repair and may suffer on-going symptoms of incontinence, urgency and pain.
