At Risk of an OASI and Claiming for Negligent Maternity Care

All women who give birth through the vagina should undergo a thorough perineal examination following the birth of their baby.

For those women who are particularly at risk of an OASI during childbirth, however, it is especially important and a failure to do so may leave the new mother with permanent and disabling bowel problems.

It may also justify a claim for compensation for the consequences of the negligent maternity care which it represents.

At risk of an OASI

An OASI is an obstetric anal sphincter injury during childbirth which causes damage to the muscles around the anus. These muscles allow a woman to control the passing of wind and faeces.

Certain groups of women are more likely to suffer an anal tear during childbirth including the following:

  • Women who are giving birth through the vagina for the first time
  • Women who have required an instrumental delivery, especially where forceps were used
  • Women of Asian heritage
  • Women who are giving birth to a large baby

Negligent maternity care

Examples of maternity care which may be regarded as negligent in relation to an anal injury could include the following:

  • A failure to carry out an examination following the birth of the baby. This should include a digital rectal examination to check for damage to the anal sphincter
  • A failure to identify that damage has occurred to the anal sphincter
  • A misdiagnosis of damage such as identifying a 3c tear as a 3a tear
  • A failure to carry out an effective and comprehensive repair
