Anal Problems After Childbirth and When to Claim Compensation

Negligent Birth Tear Compensation ClaimsIf you are having difficulty controlling the passing of wind and faeces following the birth of your baby, you may be suffering with an unrepaired 3rd or 4th degree tear.

Post-natal anal problems

Occasionally, a new mother starts to develop problems controlling her bowel shortly after the birth of her baby.

It can develop into a pretty miserable and disabling scenario as incontinence of both wind and the passing of faeces adversely affects the woman's self-confidence and restricts the way in which she feels able to live her life.

The financial implications can also be significant. If the severity of her bowel symptoms mean that she can no longer continue in her former employment or is restricted in the number of hours she is able to work, she may suffer a considerable loss of earnings.

If she requires specialist equipment or treatment in order to help her manage her physical and psychological difficulties, there would be associated costs of this.

If this distressing outcome is found to have been the result of negligent maternity care following the birth of her baby, it may be appropriate to make a claim for compensation which would address the above financial losses.

What constitutes negligent anal care?

As a severe birth tear, referred to as a 3rd or 4th degree tear, is a known risk of vaginal childbirth, maternity professionals are expected to carry out the necessary checks for any sign of an anal injury.

Negligent maternity care which might result in a new mother being discharged from hospital with an unrepaired anal tear could include the following:

  • A failure to carry out a thorough examination following the birth of the baby including a digital rectal examination
  • A failure to identify an injury to the anal sphincter
  • A misdiagnosis of an injury to the anal sphincter such as diagnosing a 4th degree tear as a 4rd degree tear
  • A failure to achieve a full and effective repair

If you suspect that this is what happened to you, talk to a specialist solicitor who will request copies of your medical records from the hospital and analyse the quality of your maternity care.
