A 3rd degree tear is not in itself a negligent event. Although it is an extensive injury, it is a risk of childbirth that cannot be predicted or prevented. The above examples amount to medical negligence, firstly because they should not happen, and secondly because they will cause the patient to suffer wrongful harm. Symptoms such as faecal urgency and incontinence will develop. It is likely these problems would not have occurred, had the patient received an acceptable standard of care.
