Can I Claim For Professional Negligence?

Who can make a professional negligence claim?

You can make a professional negligence claim against your solicitor if:-

1. Your solicitor has breached their duty of care towards you; and

2. This breach of duty has caused you to suffer injury

Breach of duty

All solicitors owe their clients a duty of care. This means a solicitor must exercise reasonable skill and expertise when acting for you. If your solicitor acts in such a way that is considered unreasonable, he or she will have breached their duty of care towards you.

There are various ways in which a solicitor can breach a duty of care towards a client, including:-

  • Missing deadlines to submit certain documents
  • Settling a claim for less money than it is worth (called under-settling a claim)
  • Failing to conduct a claim in an appropriate manner (such as failing to seek independent expert reports)
  • Acting dishonestly
  • Making mistakes in legal documents that renders them invalid, or affects the prospects of a claim


When a solicitor breaches their duty of care, it is very possible that this will have an adverse effect on the client. For example, it may even mean that their medical negligence or personal injury claim can no longer proceed. Consequently all the time that has been spent on the case will have been wasted, and a client will not have been awarded the compensation to which they are entitled.

If a breach of duty does cause you to suffer some form of injury, there will be grounds for a professional negligence claim.
