This included ensuring an expert does fully understand the Bolam test, a reminder of the practicalities of treating patients in the NHS setting and not applying a higher standard of the Bolam test; and has the expert taken sufficient care with their diagnostic reasoning in their report.
Sophie Holme of Guildhall Chambers presented on Contemporary Issues in Spinal Treatment Cases, an area of importance given the complexities involved in assessing treatment decisions and potential negligence particularly in CES (Cauda Equina Syndrome) cases.
Professor Ying Cheong, Professor of Reproductive Medicine, then examined the question of responsibility in the changing landscape of fertility care. This was a fascinating insight into the changes in fertility care including the technological advancements which raises important questions around clinical responsibility.
Dr Steve Allen, Consultant Radiologist at The Royal Marsden, provided a radiologist’s perspective on The Pitfalls of Cancer Imaging Reporting. The session focused on the interpretation and reporting of imaging. My takeaway from this was the importance of reporting incidental findings on imaging.
The final presentation, LXLP v St George’s University Hospitals NHS Foundation Trust, was delivered by Rob Sowersby and Alastair Prince of Guildhall Chambers. A reminder that even if there was an admitted breach this will not result in a successful claim if causation cannot be established and that clinical guidelines are not law.
It was an excellent afternoon of insightful presentations and an opportunity to reflect on the challenges and developments shaping clinical negligence work.

Thank you to all the speakers and organisers for contributing to this year’s seminar.

Please call us on 0800 234 3300 (or from a mobile 01275 334030) or complete our Online Enquiry Form.

On Thursday 15 October 2026, senior solicitor Laura Merry attended Guildhall Chambers Annual Clinical Negligence Seminar at the Bristol Marriott Royal Hotel.
