Suing the NHS for a 3rd degree tear

A 3rd degree tear is when the perineum and anal sphincter complex tear during a vaginal delivery. It is an accepted risk of childbirth, yet it leads to a number of successful compensation claims every year.

However, because a 3rd degree tear is an accepted risk of childbirth, the injury is not itself considered negligent. Just because you suffer a 3rd degree tear does not automatically mean you are entitled to make a claim. You may have received the highest standard of care and still had a tear.

So why do 3rd degree tears lead to so many patients to sue the NHS? Some of the most common reasons for a 3rd degree tear claims are listed below:

  • The actions of medical practitioners directly caused a 3rd degree tear to happen
  • A 3rd degree tear was not diagnosed shortly after the birth
  • A 3rd degree tear was wrongly diagnosed as being a more minor tear
  • A 3rd degree tear was not repaired because it was missed
  • The full length of the 3rd degree tear was not repaired because of a misdiagnosis
  • A 3rd degree tear was repaired but to a poor standard
  • A 3rd degree tear became infected but the infection was not diagnosed and treated
  • Other complications were not detected and treated, preventing a 3rd degree tear from healing
