How long does a medical negligence claim take?

Every medical negligence claim is different and there is no set amount of time a claim will take. On average, a claim will take between two to three years to complete.

For more complex claims, it can take more than three years for a claim to settle. This is more common in cases where mental capacity is an issue, such as cerebral palsy. Additionally, there is no time limit in cases when the Claimant has not mental capacity or is under the age of 18, so time constraints are not a problem.

Why does it take so long?

You may be surprised that a claim takes such a long time. However, it is important to fully investigate the claim. There are also many steps that have to be completed, and when you add all these up it can take a couple of years from start to finish.

You may have read elsewhere that your claim can be quickly resolved. This may sound like an attractive offer, as understandably you will want to put the whole experience to the back of your mind as soon as possible.

Nevertheless, you should be wary of anyone offering a 'quick fix'. As mentioned above, medical negligence claims must be thoroughly investigated and each stage of the process adhered to. If any corners are cut, it could mean that your case is ultimately unsuccessful, or that you receive less compensation that you should.

What if I run out of time?

Medical negligence claims have to be issued before the courts within three years of the event. There are some exceptions to this rule, including if the Claimant lacks mental capacity or is under the age of 18. Otherwise you have just three years to make a claim. If you do not claim within this time you will not be able to pursue legal action, even if you have a strong case.

Therefore it is best to seek legal advice as early as possible. If you speak to a solicitor three years after the event (or it is coming up to three years), you will have run out of time.
